If Captain James Woods has not completed his 
survey for me by the time the principal and interest 
of the sale of Cannon Hill in Surrey has been 
received, my son Charles or any other person my 
executors shall think appropriate person to purchase 
or take up on some of the waters beyond the 
Allogano or Appalachian Mountain 8000 acres in 
one body of which my loving wife shall build on and 
there remain during her natural life and at her pass 
to my eldest son Charles Jerningham, the remaining 
6000 acres to be equally divided among my six other 
children viz Frances Henrietta, Mary, Alloisa, 
Edwardina, Olivia, and my son Henry Tobias 
 
At the age of 14 my son Henry Tobias is to be 
labored out to a Baculor suitable to his condition til 
he obtains the age of 20.  

If any of my children protest or dispute 
Maryland...who doth shall moving out of the
